Terms of Service
B&B Gaming (beta)
Version 2 — effective October 14, 2026
Please read section 18. It requires individual arbitration of most disputes and waives class actions and jury trials, unless you opt out within 30 days.
B&B Gaming is operated by TBJ Technologies, a sole proprietorship owned by T. Brian Jones ("we," "us"). These Terms of Service ("Terms") are an agreement between you and us. They govern your use of bandbgaming.com and the services offered on it (the "Service"). By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree, do not use the Service.
1. Beta
The Service is a beta. It is experimental and may not work as described. We may change, limit, suspend, or end any part of the Service, or the beta as a whole, at any time and without notice. During the beta we may reset, change, or delete accounts and content, and when the beta ends, token balances and content may be reset or cleared. Keep your own copies of anything you want to keep.
2. Eligibility and accounts
You must be at least 18 years old. The Service is offered only to people in the United States. Access to the beta may be limited, for example to invited users, and we may refuse or remove access at any time.
You are responsible for your account, for keeping your sign-in secure, and for everything done under it. Tell us at support@bandbgaming.com if you believe someone else has used your account. Your username is public. We may change or reclaim a username, for example if it infringes someone else's rights or misleads people.
3. What the Service does
The Service uses third-party artificial intelligence ("AI") models to turn your text and images into concept images and 3D models. It then processes those models, for example by repairing or scaling them, so that you can download them. The Service's assistant is an AI, not a person.
AI output is generated automatically and is unpredictable. We do not review it before you receive it.
4. Your prompts and uploads
"Your Content" means the text, prompts, messages, images, photos, files, and other material you submit to the Service, and the output generated for you from it.
You are responsible for what you submit and for how you use any output. You confirm that you have the rights needed to submit your prompts, images, and other material and to let us use them as these Terms describe, and that submitting them does not violate these Terms, the law, or anyone's rights, including copyright, trademark, publicity, and privacy rights.
Do not ask the Service to recreate characters, miniatures, logos, or other material that belongs to someone else, such as a game publisher's models or settings, unless you have the right to do so. A prompt that names a brand or product does not give you any rights in it.
You agree that we and our service providers, including our AI providers, may receive, record, store, and process your messages, prompts, uploads, and activity in the Service as described in these Terms and our Privacy Policy.
5. Ownership and licences
Your rights. As between you and us, you keep whatever rights you have in Your Content. AI output may not be protected by copyright, and we do not promise that you have, or can get, any intellectual property rights in it.
Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, modify, create derivative works from, transmit, and display Your Content to operate, secure, improve, and develop the Service and our other products, including to train, evaluate, and improve AI models. We may sublicense these rights to our service providers for those purposes. For content you publish, the licence also covers displaying and distributing it on and off the Service, including to promote the Service. This licence is perpetual and irrevocable for content you publish. For other content it ends when the content is deleted, except for copies in backups and AI models already trained with it, which we are not required to change.
AI providers. The AI providers that process Your Content for us may also use it, and the output, under their own terms, which may allow them to use it to improve their models.
Published content. When you publish a model or photo, other users may see it, and may download, print, or remix it only as far as the licence shown with it on the Licences page allows. Each model is governed by the licence version it was published under. When you publish under a licence, you also grant us every right that licence version gives B&B Gaming. The licences you grant us and other users for published content are perpetual and irrevocable. If you unpublish or delete content, copies that others have already downloaded or remixed are not affected. We may keep published content, and the remix history connected to it, after you unpublish it or close your account.
Using others' models. When you download, print, or remix a model, you agree to the licence version shown with it, whether or not the model is protected by copyright. We may enforce that licence.
Our Service. We own the Service, including its software and design. We grant you a limited, personal, revocable, non-transferable licence to use the Service under these Terms.
6. No promises about output
We do not promise that any output, including images, models, sizes, descriptions, tags, or estimates, is:
- original, unique, or different from output produced for someone else;
- free of third-party intellectual property, including trademarks or recognisable designs;
- accurate, complete, or what you asked for; or
- printable, manifold, to scale, structurally sound, or suitable for any printer, material, or game.
You are responsible for checking every file before you print, share, or sell it. 3D printing involves hot equipment, chemicals, and small parts. You print at your own risk.
7. Third-party brands
We are not affiliated with, endorsed by, or sponsored by any game publisher, miniature maker, printer maker, or other brand named on the Service. Names of games, products, and companies are trademarks of their owners. We use them only to describe what a user asked for or what a model is compatible with.
8. Acceptable use
You may not use the Service to:
- infringe or misappropriate anyone's intellectual property or other rights;
- create or share content that is unlawful, sexually explicit, hateful, or harassing, or that depicts real people;
- upload photos of real people, or images that show anyone's personal information;
- make weapons, weapon parts, or anything designed to cause harm;
- misrepresent the source of content, or remove licence or attribution information;
- violate the usage policies of the AI providers we use to run the Service;
- break, probe, overload, or get around limits or security in the Service, or access it by automated means except through features we provide;
- resell, sublicense, or provide the Service to others, or use the Service to build a competing service; or
- manipulate tokens, votes, invites, or referrals.
9. Moderation and removal
We may, but are not required to, review, filter, refuse, hold, or remove any content, prompt, or job, and suspend or close any account, at our discretion and without notice, including where we think content may infringe someone's rights. Automated checks may refuse a request.
10. Copyright and trademark complaints
To report content that you believe infringes your copyright, send a notice through our copyright page, or to our designated agent at support@bandbgaming.com or at the address listed for our designated agent in the U.S. Copyright Office's DMCA directory. If your content is removed after a notice, we will tell you, and you may send a counter-notice through the same page. To report a trademark, privacy, or other rights concern about content, email support@bandbgaming.com. We may forward a notice, including the sender's contact details, to the person who posted the content. We suspend accounts that receive repeated valid complaints and, in appropriate circumstances, terminate them.
11. Tokens
Tokens are a limited, revocable licence to use features of the Service. They are not money, property, or a stored-value instrument, have no cash value, and cannot be sold, transferred, or exchanged for cash, except where the law requires otherwise.
We decide how many tokens each action costs and may change those costs, and how tokens are granted, at any time. We may adjust, revoke, or expire tokens that were given free of charge, including beta and invite grants, and tokens obtained by mistake, fraud, or a breach of these Terms. Unused tokens are forfeited when your account closes or the beta ends, unless the law requires otherwise. If a job fails, the Service normally returns its tokens automatically; we decide any other restoration.
12. Paid features
If we offer purchases, subscriptions, print orders, creator earnings, or payouts, additional terms will apply and will be shown to you before you use them.
13. Feedback
If you send us ideas or feedback, we may use them for any purpose without paying or crediting you.
14. Termination
You may stop using the Service at any time, and you may delete your account in your account settings once any open items shown there are resolved. We may suspend or end your access at any time, for any reason, including a breach of these Terms. Sections that by their nature should survive termination do, including sections 4 through 7, 11, 13, and 15 through 19.
15. Disclaimer
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT OR DATA WILL BE KEPT OR NOT LOST.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNER, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, CONTENT, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR US $50.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR ANYTHING ELSE THAT APPLICABLE LAW DOES NOT ALLOW US TO LIMIT.
17. Indemnity
You will defend, indemnify, and hold harmless us and our owner, contractors, and suppliers from any third-party claim, loss, or expense (including reasonable legal fees) arising from content you submit, publish, share, print, or sell, or from your breach of these Terms or of anyone's rights, except to the extent the claim is caused by our own negligence or misconduct. We may control the defence of any claim you indemnify, and you will cooperate.
18. Disputes
Governing law. These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. The Federal Arbitration Act governs this section.
Informal resolution first. Before starting arbitration or a court case, a party must send the other a written description of the claim and try to resolve it informally for 60 days. Send yours to support@bandbgaming.com; we will send ours to the email address on your account. Time limits for bringing the claim are paused during those 60 days.
Arbitration. Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Consumer Minimum Standards. We will pay the fees those standards require a business to pay. The arbitration will be held by videoconference. Its legal seat is San Diego County, California. If the arbitrator decides an in-person hearing is needed, it will be held in San Diego County or, if you prefer, in the county where you live. The arbitrator may award any individual relief a court could award. The arbitrator decides questions of arbitrability, except that a court decides any challenge to the class-action waiver, the public-injunctive-relief paragraph, or the batching sentence below.
Exceptions. Either party may instead bring an individual claim in small-claims court, and either party may ask a court to stop infringement or misuse of its intellectual property.
No class actions or jury trials. Claims may be brought only individually. You and we waive any right to bring or join a class, collective, or representative action and, to the extent the law allows, any right to a jury trial. There is no class or collective arbitration. If 25 or more similar demands are filed by or with the help of the same law firm or organisation, they may be administered in batches under the JAMS Mass Arbitration Procedures, and time limits for bringing the claims are paused while they wait. If the class-action waiver is found unenforceable for a claim, that claim proceeds in court and not in arbitration.
Public injunctive relief. Nothing in these Terms waives your right to seek public injunctive relief (relief whose main purpose is to protect the general public from unlawful practices). A claim for that relief will be decided by the courts below, not in arbitration, and will be stayed until the arbitration of any individual claims is complete.
Opting out. To opt out of arbitration, email support@bandbgaming.com from your account email address within 30 days after you first accept these Terms, stating that you opt out of arbitration. If you opt out, disputes go to the courts below instead of arbitration, and the waivers above apply only to the extent the law allows.
Courts. Any dispute that is not arbitrated will be resolved only in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction.
Changes to this section. A change to this section does not apply to a dispute that arose, or that either party had notice of, before the change took effect.
19. General
We may change these Terms. We will post the new version with a new date and, for a material change, notify you through the Service or by email and may ask you to accept it. Changes apply going forward only. These Terms, and the licence versions referred to in section 5, are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them, including in a merger, acquisition, or sale of assets, or a transfer of the Service to a company we form. We are not liable for delays or failures caused by events beyond our reasonable control.
20. Notice for California users
